Terms of service

These terms govern your use of froliko.com and any order you place through it. Please read them before you buy. By placing an order you accept them.

1. Who you are contracting with

froliko.com is operated by AEROSMART TECHNOLOGY LIMITED, trading as Froliko, of Flat/Rm 1006, 10/F, Po Yip Building, 23 Hing Yip Street, Kwun Tong, Kowloon, Hong Kong SAR (“Froliko”, “we”, “us”). Contact: info@froliko.com.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to buy from this site. By ordering you confirm that you are, and that the payment method you use is yours to use.

3. Products, descriptions and colour

Our products are textiles. Dimensions we publish are the specification we manufacture to; woven linen moves in finishing and washing, so allow approximately one centimetre of variance on a finished piece. Colour on your screen is an approximation and varies with your display — slight variation between batches is a property of dyed natural fibre, not a defect.

We may change the range, discontinue a colourway, or correct a description or price at any time. If we correct a price after you have ordered but before we ship, we will tell you and you may cancel for a full refund.

4. Orders and acceptance

Your order is an offer to buy. The confirmation email we send you acknowledges that we received it; the contract is formed when we dispatch the goods. We may decline or cancel an order — and will refund you in full if we do — where an item is out of stock, where a price or description was clearly wrong, where we cannot ship to your address, or where the order is flagged as fraudulent.

5. Prices and payment

All prices are in US dollars (USD) and are shown exclusive of any import duty or tax charged by the destination country, except where we state otherwise at checkout. Your card is charged when the order is placed. If your card is denominated in another currency, your bank sets the conversion rate and may add a fee; that fee is between you and your bank.

6. Shipping and risk

Delivery estimates are estimates, not guarantees, and run from dispatch rather than from the moment you order. Risk in the goods passes to you on delivery. Our Shipping Policy forms part of these terms.

7. Returns and cancellation

You may return most items within 30 days of delivery on the terms set out in our Refund Policy, which forms part of these terms. Nothing in these terms limits any statutory right you have as a consumer in your own country.

8. Acceptable use

You may not use this site to break the law, to place fraudulent or automated bulk orders, to scrape or copy our photography and text for commercial use, to introduce malicious code, or to attempt to gain unauthorised access to any part of the site or its systems.

9. Intellectual property

The Froliko name, our product designs, photography, illustrations and site copy are owned by us or licensed to us. You may not reproduce them commercially without our written permission. You keep ownership of anything you send us, but you grant us a licence to use a review or a photograph you submit in connection with the product it relates to.

10. Accounts

If you create an account, keep your password to yourself and tell us promptly if you think it has been compromised. You are responsible for orders placed through your account. We may suspend an account that is being used in breach of these terms.

11. Liability

We supply goods for domestic and household use. To the fullest extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss arising from your use of a product in a way it was not intended for. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Where liability can be limited, it is limited to the amount you paid for the item concerned.

12. Events beyond our control

We are not liable for delay or failure to perform caused by something outside our reasonable control — including carrier disruption, customs delay, extreme weather, industrial action, epidemic or act of government. If such an event continues for more than 30 days you may cancel any undelivered order for a full refund.

13. Changes to these terms

We may update these terms. The version in force is the one published on this page when you place your order, and we will update the date at the top when we change it.

14. Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and disputes are subject to the non-exclusive jurisdiction of the Hong Kong courts. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of your own country.
